Content widget misclassified as non-advertising

Outbrain's content discovery widget is frequently assigned to a Content or Functional consent category rather than Advertising. The widget collects behavioral data for retargeting, which requires an Advertising category assignment.

Cross-publisher behavioral tracking

Outbrain tracks visitor behavior across its publisher network, not just on the site where the widget is deployed. Cross-site behavioral tracking requires consent from the visitor on each site in the network.

Retargeting pixels fire alongside content widgets

Outbrain often deploys both a content widget and a separate conversion or retargeting pixel. The retargeting pixel may have no consent condition even when the widget has one, creating a gap in the consent implementation.

Consent and configuration

The content recommendation presentation does not change the advertising nature of Outbrain's data collection. Both the widget and any associated retargeting pixels need to be assigned to an Advertising consent category and confirmed to stop in the reject state.

  • Outbrain widgets should be assigned to an Advertising consent category in the active CMP, not Content or Functional.

  • Any separately deployed Outbrain conversion or retargeting pixel needs its own consent condition in the CMP or tag manager.

  • GPC signal handling for Outbrain tracking needs a blocking condition at the tag or CMP level.

Regional compliance

The content recommendation format does not create an exemption from GDPR or CCPA/CPRA consent requirements. Behavioral data collected by Outbrain across publisher sites is personal data under GDPR, and cross-site tracking for advertising purposes requires opt-in consent in European jurisdictions. Under the CPRA, opt-out rights apply to data sharing with Outbrain for cross-context behavioral advertising and measurement purposes.
